Hesays ’In my opinion any gunmade in 1898 is an antiquerearm irrespective of whatcartridge it is chambered for.’If by this he means that sucha gun should be treated bythe law as an antique, I quiteagree. But if he means any late19th-century gun is a Section58 antique irrespective of whatcartridge it is chambered for,this is surely wrong, as manyguns from the period acceptreadilyavailablemodernammunition – a Lee-Metford.303 ri e, for example, or aSmith & Wesson .22 revolver –and therefore at best require anFAC, or at worst are completelyprohibited, possession carryinga mandatory ve-year prisonsentence.Someone nding an old gunin their grandfather’s attic,say, and taking Bill’s adviceliterally, could nd themselvesin big trouble.Paul WilliamsQA&ASK THE EXPERTfirearm’ for the purposes of Section58(2) of the Firearms Act 1968.The final arbiter in law is a courtin the event of any prosecution. Thatis the only mechanism whereby ade nitive ruling on a rearm’s statuscan be obtained. Consequently, theHome Of ce has issued guidanceto the police to provide a workingframework of what might ‘of cially’be considered to be an antique. Thisis arti cial and politically inspiredbeing based on the free availability ofthose rearms which are not deemedeither to be attractive to criminalsor which pose no tangible threat topublic safety.The underlying principle iswhether ammunition is ‘commerciallyavailable’i.e. can you go into Bloggs’Gunshop and buy it off the shelf?To my mind that principle isneither legally nor intellectuallysustainable. In my opinion, a .45Colt SAA revolver made in 1885 isan antique by virtue of its age andits technical obsolescence. By thesame token it would be ludicrous tosay that an 1885 Benz car was notan antique motor car because it ispowered by petroleum spirit, availablefrom all good lling stations. Inlaw, the test of whether somethingis antique is its age and possibly itstechnical obsolescence.The Home Of ce guidance maybe a useful starting point for de ningantiques but it has no legal status.Some years ago, The Recorder ofCardiff, HH Judge Cooke, describedit as ‘an unauthoritative’ statementof the law which was plainlyinadmissible, i.e. it could not be usedin court.It would be disingenuous of me tocondemn the Home Of ce guidance.out of hand as it contains some usefulmaterial. Section 2.40 contains aQAlist of criteria which may be used todetermine if a rearm is an antique.They are:• An indication of date of manufacture• Details of technical obsolescence• A lack of commercial availability ofsuitable ammunition or• A written opinion by an accreditedexpert.More importantly, the guidancecon rms that in the event of aprosecution, it is up to the Crown toprove that the gun is not an antique.That is a very heavy burden of proofand it is always dif cult to prove anegative. I would hope that no right-minded expert with an eye on hispersonal credibility would give evidencethat an old gun was not an antique.To sum up, therefore, I would saythat Paul Williams’ notional .303Lee Metford ri e is an antique rearmby virtue of its age and its technicalobsolescence. That is my opinion as anexpert. I hope it carries weight with thecourts. The Guidance should certainlybe changed to classify it as an antique.My advice to anyone who wants togo outside of the guidance is to getan opinion from an accredited expertand then speak to the local rearmslicensing manager.Bill Harriman is a professionalmember of the ForensicScience Society and a Fellowof the Society of Antiquaries,thus, a nationally recognizedrearm expert. The Scottish Police saythat I am not allowed to use iton a range because of this. Arethey right?(Name and addresssupplied)It is an offence under theCriminal Justice Act 1988to have any pointed or bladedarticle in a public place without lawfulauthority or reasonable excuse. As youhold this carbine on the authority ofa Firearm Certi cate you have lawfulauthority to possess it in a public placebecause its bayonet is an integral partof it.In any case you would certainlyhave reasonable excuse for transportingit from your home to a range becausethat is explicitly allowed by condition4(b) on your certi cate which refersto ‘transit’.A range is not ‘a public place’ for thepurposes of the Firearms Act 1968,so no offence is committed . There isno reason why you should not reyour carbine with the bayonet xed orun xed because that is how the gun wasoriginally designed. There is no reasonwhy you should not possess any otherbayonet for a ri e that you own. In anycase, many militaria enthusiasts collectbayonets in their own right.To my mind any military ri e oughtto be accompanied by its cleaning kit,ammo pouch(es), bayonet etc to forma micro collection around it.
